The REAL ID Act was passed in 2005 in an effort to establish the identity of individuals living within the United States. One of the requirements under the Act was to secure the issuance of state driver’s licenses and ID cards — in essence, turning these forms of identification into national identity cards that track whether or not a person is legally in the United States. While these laws were intended to improve our country’s national security, there have been many immigration consequences that have negatively affected non-U.S. citizens living in the United States. For instance, there are now stricter standards in place applying for non-U.S. citizen immigrants in being able to obtain a driver’s license, to work in the United States, or to travel internationally, especially now that our federal and state governments are enforcing the REAL ID Act provisions. Even worse, without being able to show proof of legal status, many individuals cannot obtain renewal of their driver’s licenses, and this has forced many individuals who are not legally here into immigration custody. Because of this, many more aliens who are not legally in the United States are forced by ICE (Immigration and Customs Enforcement) or the immigration courts to return to their foreign country.
